Terms of Service

Zelper is a creator intelligence platform built for brand teams and marketing agencies. The Service enables users to discover, analyse, and compare content creators across platforms including TikTok, Instagram, YouTube, Reddit, and Twitch, using proprietary scoring and analytics.

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use the Service. By creating an account you represent that the information you provide is accurate and that you will keep it up to date.

You are responsible for all activity that occurs under your account. You must not share your credentials or allow others to access your account. Notify us immediately at suport@zelper.io if you suspect unauthorized access.

Access to certain features of the Service requires a paid subscription. Subscription plans, pricing, and features are described on the pricing page and may change at any time with 30 days’ notice.

• Subscriptions are billed monthly or annually, in advance.
• All fees are non-refundable unless required by applicable law or otherwise stated at the time of purchase.
• Failure to pay may result in suspension or termination of your access without notice.
• Taxes may apply depending on your jurisdiction; you are responsible for any applicable taxes.

During any free trial, your account will have access to paid features for the trial period. At the end of the trial, your subscription will convert to a paid plan unless you cancel before the trial ends.

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Scrape, copy, or reproduce any portion of the Service or its underlying data beyond what is permitted by these Terms.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service to harass, defame, or harm any individual or entity.
• Circumvent any rate limits, access controls, or security features.
• Use automated tools or bots to access the Service without our prior written consent.
• Use outputs from the Service to train, fine-tune, or develop competing machine learning models.
• Resell, redistribute, or sublicense access to the Service to third parties.

The Service aggregates and analyses publicly available data from third-party social media platforms (“Platform Data”). This data is collected in accordance with the terms of service and developer policies of each respective platform (including TikTok, Meta, Google/YouTube, Reddit, and Twitch).

You acknowledge that:

• Platform Data is subject to change and may become unavailable due to platform policy changes, API restrictions, or other external factors outside our control.
• Creator metrics, scores, and analytics are estimates based on available data and are provided for informational purposes only. They do not constitute guarantees of performance.
• You are solely responsible for how you use creator data in your campaigns, contracts, or business decisions. We are not liable for decisions made based on our analytics.
• You will not use creator data in any way that violates applicable privacy laws, platform policies, or any creator’s rights.

The Service, including its interface, branding, algorithms, scoring methodology, reports, and software, is owned by Zelper Professional Corp and is protected by copyright, trademark, and other applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes during the term of your subscription. This licence does not include the right to sublicense, resell, or create derivative works from the Service.

Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without restriction or compensation.

Both parties may have access to confidential information in connection with the Service. Each party agrees to protect the other’s confidential information using at least the same care it uses for its own confidential information, and not to disclose it to third parties without prior written consent, except as required by law.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Creator data may be incomplete, delayed, or inaccurate due to factors beyond our control.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ZELPER, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO ZELPER DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Zelper Professional Corp and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.

Either party may terminate these Terms at any time. You may terminate by closing your account and discontinuing use of the Service. We may terminate or suspend your access immediately, without notice or liability, if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination (including IP, liability, indemnification, and dispute resolution) will survive.

These Terms are governed by the laws of the State of Maine, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall first be submitted in good faith to informal resolution by contacting us at suport@zelper.io. If not resolved within 30 days, disputes shall be resolved through binding arbitration in Lewiston, Maine, in accordance with the rules of the American Arbitration Association.

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
